Alina Habba has stepped down as the chief federal prosecutor in the state. This decision was prompted by a legal ruling that challenged her eligibility to hold the office.
Acceptance of Resignation
US Attorney General, Pam Bondi, confirmed her stepping down on Monday. In a statement that the appeals court finding made it impossible for Habba to effectively run her office.
"But do not mistake adherence to the ruling as defeat," Habba stated. "My fight will now extend throughout the nation."
Court Ruling
Habba's exit comes a week after a federal appellate panel found that she had been serving in violation of the law as the federal prosecutor. This ruling is expected to impact scores of legal proceedings in the Garden State.
The judicial panel ruled that a interim role that skirted Senate approval breached the federal law governing appointments.
Ongoing Legal Battle
It was also stated that the former prosecutor will continue working within the Department of Justice as a high-level advisor. Habba plans to pursue additional appeals of the court's action, aiming for a different outcome.
In a statement, she wrote that the judiciary "should not be able to override the appointment of attorneys responsible for carrying out the fundamental role of the presidency of prosecuting crime."

Bondi highlighted the prosecutor's work and said that under her leadership, the city of Newark saw a significant drop in crime. It was also reported that the Camden recorded its initial homicide-free summer since 1974 without a homicide.
Connection to Donald Trump
Habba, was initially recruited to the former president's legal defense in recent years. She later defended the former president in his hush-money trial in New York last year, when he was conviction on multiple felony counts of financial record manipulation.
Before her appointment to the federal prosecutor position, the former president had stated he was naming her as his presidential counsellor if re-elected, labeling Habba as a steadfast ally and a "tireless advocate for justice".
