A court has ordered the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his ongoing confinement lacks lawful basis.

"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her order.

The case originates in a erroneous deportation to El Salvador in March, which the government later admitted was an error. After his return to the United States to face human smuggling allegations, he was detained in federal detention.

In her order, the court pointed out that the authorities lacks a current removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
